Terms and Conditions

These terms and conditions (the “Terms”) govern how the users (the “Customer” or “you”“your”) use the sponsor licence checking service (the “Service”) at https://www.nationbetter.uk/ (the “Website”). The Service is offered by Betternations Ltd, who is trading under the name “Nation.better” (“Nation.better” or “we”“us”, “our”), is a company registered in England and Wales with company number 12066785 and its registered office address at 128 City Road, London, United Kingdom, EC1V 2NX. Nation.better is registered with the Immigration Advice Authority (IAA), Ref. No: F202100313.

 

The Sponsor Licence application checking service is a limited service whereby Nation.better will review the documents, online application and other relevant data you have provided by uploading them via digital form or email, and we provide one written advice containing actionable feedback on how to improve the application. The written advice will also detail any problems you may have with your application, the chances of success, and how to resolve any resolvable issues.

 

You accept the Terms by clicking “Pay” or a similar button when you pay for the Service. 

 

In addition, when you use the Service you are subject to any guidelines, rules or terms applicable to the Service which may be posted at the Website from time to time. All such guidelines, rules or terms including without limitation our privacy policy (the “Privacy Policy”) are incorporated by reference into the Terms.

 

The Terms are a binding and legally enforceable agreement between you and us. If you accept the Terms on behalf of a corporation, partnership, association, or other entity or group, or if you have authorised any other entity or individual to accept these Terms on your behalf, you represent and warrant that you are authorised to legally bind such entity to the Terms or to have such entity or individual bind you to the Terms.

 

  1. How service works. Service Fee.
     
    1. We provide you with access to the Service when you pay the Service Fee which is specified at the Website.
    2. We will provide written advice to you by email for a standard service within 4 working days (excluding weekends) of your completed uploads, and 2 working days (full 48 hours during working days excluding weekends) if you purchase our express review service.
    3. If your submission raises complex issues it may take longer, where this occurs Nation.better will notify you.
    4. If we cannot undertake the checks because the application is too complex for this service we reserve the right to partially refund your payment and recommend an alternative level of service from Nation.better.
    5. Please note that:
      1. We are under no further obligation to you other than the provision of this limited service. It is your responsibility to ensure you meet the requirements set out by the Home Office and that you follow our written advice;
      2. We are not liable for any incorrect information or documents provided by you or your employees that might adversely impact your application;
      3. Under the immigration rules you must provide only genuine documents and/or information.

 

  1. Forbidden use
     
  2. You may not:
    1. reverse engineer, decompile, disassemble, modify or create derivative works based on the Service, or any portion of it;
    2. circumvent any technology used by us, our affiliates, or licensors to protect content accessible via the Service; copy, store, edit, change, prepare any derivative work of or alter in any way any content available via the Service;
    3. use any robot, spider, site search/retrieval application, or other automated device, process or means to access, retrieve, scrape, or index any portion of the Service, or its content; rent, lease, or sublicense the Service;
    4. upload, transfer or otherwise use third-party data and/or content without having all the necessary consents;
    5. defame, abuse, harass, use threatening practices, threaten, or violate the legal rights of others in any other way (such as rights of privacy and publicity);
    6. disseminate, or publish content that is unlawful, obscene, illegitimate, defamatory, or inappropriate;
    7. use the Service in any other improper way that violates the Terms.

 

  1. Confidentiality Policy
     
  2. We undertake to preserve confidentiality about you and your application. We will not disclose information about you or your application to any third party without your permission except in the very rare event that this is legally required by a court order. The IAA is a public body, which regulates immigration advice and services within the UK. The IAA may review your file as part of their regulatory role.
  3. Where we do need to liaise with any third party about your application, we will ensure that we have your permission, in writing, for this beforehand. 

 

  1. Warranties & Liabilities
     
  2. No guarantee exists in the overall outcome of your sponsor licence application and we accept no responsibility for the final decision taken by the UK Home Office/UK Visas & Immigration. We can confirm that we have professional indemnity insurance arising from any claims made against us during the application process.

 

  1. Termination & Suspension
     
  2. This agreement will be automatically suspended whereby events occur outside the control of both parties, and any service fees paid by you will be refunded pro-rata. 
  3. Should you decide to terminate the service, we will be able to provide a partial refund (£440+VAT) after you receive our service instructions with a list of documents and step-by-step guide, and before you have completed your uploads and the checking begins. However, once we commence our checks we will not be able to refund payments because our review will have commenced.

 

  1. Your file
     
  2. The IAA requires us to keep a copy of your case file for at least 6 years after your service is delivered. As a paperless office we do not keep physical files but we will keep an electronic copy of your file which may be reviewed by the IAA. We will charge a reasonable fee for retrieval of your file.

 

  1. Changes in immigration law
     
  2. We are not liable for any delays, cancellations or in-eligibility towards your sponsor licence application if at any point during the process of your application changes to any immigration law occurs. In such a case you would not be entitled to a refund of our service fee.

 

  1. Complaints procedure
     
  2. If at any stage you have any concerns regarding the conduct of your service, please raise them with us. Nation.better will always try to provide you with an opportunity to tell us of your concerns and will work with you to try to resolve them. Please let us know if you would like full details of our complaints procedure.
  3. If you are not satisfied with any aspect of our service you may initially want to discuss this with our Immigration advisor Oxana Macovsca, who can be contacted via email at [email protected], to see if the matter can be resolved quickly.
  4. If you have spoken to the adviser or if you do not wish to discuss your concerns with them, you may wish to make a formal complaint. You can make your complaint in writing to Larisa Budaeva, who is the Managing Director at Nation.better.
